Abstract

The Supreme Court, as the highest judicial authority in both legal systems, the Civil Law Group and the Common Law Group. In each legal system, the structure and functions of the court may vary according to the judicial system. In America,The court holds the power of judicial review, the ability to invalidate a statute for violating a provision of the Constitution. wile in Iran, the Supreme Court established to supervise the correct implementation of laws by courts of justice and consisting of the most prominent judges of the country. The head of the judiciary assigns criteria to ensure uniformity of judicial procedure and to carry out all legal responsibilities. Understanding the structure and powers of the Supreme Court of any country will plays an important role in understanding the legal system of that country. This article aimed to identify the structure, duties and authority as well as the jurisdiction of the Supreme Court in Iran and the United States of America to conduct a comparative study of this supreme judicial authority in these two countries.
